Terms of Service

Effective date: October 15, 2026

These Terms of Service govern your use of afootincoldwater.com and any order you place through it. Using the site or buying from it means you accept these Terms together with our Privacy Policy, Shipping Policy and Refund and Returns Policy. If you do not accept them, please do not use the site.

1. Who you are dealing with

Afootincoldwater is the trading name of EASON FLAVOR LLC, based in COLUMBUS, OH. We sell Outdoor & Active Gear products online only.

2. Eligibility

You must be at least 18 years old to order, or have the consent of a parent or legal guardian. By placing an order you confirm that you meet that condition and that the name, address, contact details and payment information you give us are accurate, current and complete. Orders we cannot verify may be cancelled.

3. Your account

If you create an account, the login details are yours to protect. Anything done through your account is treated as done by you. Tell us at support@afootincoldwater.com as soon as you suspect someone else has access, and we will help you secure it.

4. Products and availability

Products are described on their own pages using the materials, dimensions and contents stated by the maker. We may change, restock or discontinue any listing at any time without notice. Screens render colour differently and some dimensions are measured by hand, so small variations between a photograph and the item are possible.

5. Pricing, tax and errors

Prices are shown on the site in US Dollars (USD) and do not include applicable sales tax unless we say so. The complete total, product price and tax, is displayed at checkout before you confirm. We may change prices at any time, and we reserve the right to correct an error in a price or a description even after an order has been submitted. Where a correction materially affects your order, we will contact you and give you the option to cancel.

6. Orders and acceptance

Submitting an order is an offer to buy. Our confirmation email acknowledges receipt; the contract is formed when we dispatch the goods. We may decline or cancel an order in cases of suspected fraud, a pricing error, an address we cannot ship to, or stock that has run out, and any payment taken is then refunded in full.

7. Payment

We accept Shop Pay, Visa, Mastercard, American Express, Discover, Diners Club, Elo, JCB, and UnionPay. Payment is taken securely at checkout through Shopify Payments. There are no hidden fees: every charge is set out before you confirm the order.

8. Shipping

We ship within the United States only, to all 50 states, and international shipping is not offered. Standard shipping is free with no minimum order and there is no expedited service. Timings and carrier arrangements are set out in full in our Shipping Policy.

9. Cancellations

If you need to cancel, write to support@afootincoldwater.com as quickly as you can. We will stop an order that has not yet been processed or handed to the carrier; once it is on its way, it cannot be cancelled and the Refund and Returns Policy applies instead.

10. Returns and refunds

Returns are accepted for manufacturing defects, transit damage and wrong items received. They are not accepted for change of mind or personal preference. The eligibility rules, the time limits and the procedure are set out in the Refund and Returns Policy, which forms part of these Terms.

11. Acceptable use

When you use this site, you agree not to:

• use it for any unlawful or fraudulent purpose;
• interfere with its security, availability or normal operation;
• scrape, copy, mirror or republish its content without our written permission;
• upload malware or any other harmful code;
• attempt to gain access to any part of the site, its systems or another customer's data that is not meant for you.

12. Intellectual property

The content of this site, including its text, product photography, page layouts, graphics and logos, belongs to Afootincoldwater or is used by us under licence, and is protected by copyright, trademark and other intellectual property laws. You may not reproduce, distribute, publish or make commercial use of any of it without our prior written consent. Nothing in these Terms transfers any ownership to you.

13. Disclaimer of warranties

The site and its contents are provided on an as is and as available basis. We work to keep descriptions accurate and the site running, but we do not warrant that it will be uninterrupted, error-free or free of harmful components. Product descriptions state what an item is and how it is used; nothing on this site is advice of any professional kind, and no product is offered as a treatment for any condition.

14. Limitation of liability

To the fullest extent permitted by law, Afootincoldwater and EASON FLAVOR LLC are not liable for any indirect, incidental, special, consequential or punitive damages arising out of your use of the site or your purchase of a product, including loss of data, revenue or profit. Nothing here excludes liability that cannot lawfully be excluded.

15. Indemnity

You agree to indemnify and hold harmless EASON FLAVOR LLC, its officers and its staff against any claim, loss, liability or reasonable cost arising from your breach of these Terms, your misuse of the site, or your infringement of the rights of another person.

16. Privacy

Your use of the site is also governed by our Privacy Policy, which explains what personal information we collect, why we hold it and who we share it with.

17. Changes to these Terms

We may update these Terms from time to time. The updated version is posted on this page with a new effective date, and continuing to use the site after that date means you accept it.

18. Governing law

These Terms are governed by the laws of the State of Ohio and of the United States. Any dispute arising out of these Terms or your use of the site is to be brought in the courts sitting in State of Ohio.

19. Severability and entire agreement

If any provision of these Terms is held unenforceable, the rest stays in force. Together with the policies referred to above, these Terms are the entire agreement between you and us about the site.
